What has been your most memorable case to date, and what makes it stand out?
Every case is unique. While the written law remains constant, its interpretation can vary significantly. As a patent attorney, the ability to influence and reshape these interpretations is deeply rewarding. A recent case that we handled involved negotiations between a start-up and a research institute. The issue stemmed from an inadequate pre-research agreement, leading to disagreements between the parties over the division of net income – particularly when it came to the product’s commercial value. This could have been easily resolved if both parties had considered the commercial implications before embarking on three years of research and filing successful patents.
We were brought in at a later stage by one party to navigate the issue. Over time, we took on the role of legal advisors for both sides and ultimately resolved the matter amicably with a pragmatic and cooperative approach. This reaffirmed that successful negotiation is not a zero-sum game. Fortunately, all parties exercised good judgement, which led to a favourable resolution.
You work with organisations of all sizes, from start-ups to Fortune 500 companies. How do you tailor your approach depending on the type of client you are dealing with?
I adapt my approach to the specific needs of each organisation. For start-ups, I emphasise flexibility and innovative, cost-effective solutions that support their growth while staying within budget. For medium-sized companies, I focus on optimising processes and balancing innovation with practicality, helping them to manage increased complexity as they scale. For Fortune 500 companies, I provide sophisticated, customised solutions and concentrate on effective change management to minimise disruption. We prioritise understanding each client’s unique challenges and deliver tailored strategies that align with their goals, ensuring that the solutions are both relevant and effective. Ultimately, the client makes the final decision based on the options provided.
How are you incorporating AI into your daily practice, and what is the most important lesson you have learned so far?
Incorporating AI into our daily practice involves leveraging tools to streamline and enhance the work. We are in the developmental and testing phase of using AI in various services, including legal research, document review, docketing and contract analysis to help us efficiently and accurately handle large volumes of data and provide insights that inform strategic decisions.
The most important lesson I have learned so far is the value of balancing technology with human judgement. While AI can significantly boost productivity and offer valuable insights, it is crucial to apply human expertise and critical thinking to interpret AI-generated results and ensure that they align with legal principles and ethical standards. Effectively integrating AI involves using it as a tool to support – not replace – human judgement, ensuring that real-life discernment remains central to the practice of law.
What has been the most significant IP case or legislative development in the United Arab Emirates from the past five years, and how have you adapted your approach to manage this?
One of the most notable developments was the introduction of the Federal Law No 11 of 2021. This new legislation covers patents, industrial designs, integrated circuits, confidential information and utility models, replacing the Patent Law No 17 of 2022. With this change, the procedures for filing and prosecuting patents and designs have been updated to a new online portal. As with any new system, there are challenges, which we are addressing in collaboration with IP officials. Simultaneously, we have been guiding our current and prospective clients through the new process and clarifying the ongoing changes with the IP office. Adapting to change is necessary to stay current in the business world.
How have client demands evolved over the course of your career, and how are you stepping up to meet these?
Client demands have evolved significantly. They now expect faster responses, often driven by tech advancements and a heightened focus on cost effectiveness. There is also a greater demand for personalised and proactive advice, as well as a deeper understanding of their specific business needs and industry challenges.
To meet these evolving demands, we have embraced technological tools that enhance efficiency and streamline processes, which includes leveraging AI. I prioritise continuous learning and flexibility to stay ahead of industry trends and client expectations. By fostering strong relationships and maintaining open communication, I ensure that our services are not only responsive, but are tailored to each client’s unique needs and goals.
